WRIT PETITION NO. 22 OF 2017 RAMI KHANNA AND CO. LTD., ... Petitioner

Versus

THE ADDITIONAL COLLECTOR-I (SOUTH GOA)., ... Respondent Shri C.A.Ferreira, Advocate for the petitioner. Shri S.D.Lotlikar, Advocate General with Shri S.Dhargalkar, AGA for the respondent.

Coram:- F. M. REIS & NUTAN D. SARDESSAI, JJ.

Date:- 11th January, 2017 P.C.

Heard Shri C.A.Ferreira, learned counsel appearing for the petitioner and Shri S.D.Lotlikar, learned Advocate General appearing for the respondents.

2. This is a petition seeking directions to the respondents to issue a Conversion Sanad applied by the petitioner. Shri Lotlikar, learned Advocate General submits that though the decision was taken with that regard, thereafter in view of an error committed by the concerned authorities, the charges and penalties payable by the petitioner were revised and as such a demand dated 9th January, 2017 has been issued by the Additional Collector, South Goa, Margao to the petitioner with regard to the subject Sanad. Looking into the reliefs sought by the petitioner, as the matter is under consideration by the

WP/22/2017 concerned Collector, we find that the question of invoking our extraordinary jurisdiction under Article 226 of the Constitution of India to examine the reliefs sought in the above petition would not at all be justified. The copy of the Demand notice is produced on record and marked `X' for identification and a copy thereof is also furnished to the learned Counsel for the petitioner. It is not in dispute the aggrieved party has a remedy to challenge such orders under the Land Revenue Code. As such, we dispose of the above petition by keeping all the contentions and remedies available to the petitioner to challenge the refusal or otherwise of the Conversion Sanad as well as demand notice dated 9th January, 2017 open in accordance with law.
