The learned counsel for the respondent no. 1 states that the objection that was raised was only to the effect that the certificate produced by the petitioner is not in consonance with Section 65B(4) of the Indian Evidence Act.

2. The learned counsel for the petitioner states that the certificate which was produced, and which has not been permitted by the learned Trial Judge, does not have all the particulars which are required under section 65B(4). Learned Counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to produce the certificate as per the ingredients of Section 65B(4) of the Act, before the Trial Court. The petition is accordingly disposed off

WP/45/2015 as withdrawn with liberty to the petitioner to file a fresh application, as per the requirement of Section 65B(4), which will be decided by the learned Trial Judge, uninfluenced by the earlier order passed. N. M. JAMDAR, J.
