It was the contention of Shri Amonkar, learned Advocate that the offence alleged against the applicant was primarily under Sections 504 and 506(ii) IPC and thereafter the offence under Section 384 IPC was added on investigation. The applicant would be abide by the terms and conditions as imposed by this Hon'ble Court and and therefore he had to be released on bail in anticipation of arrest.

Shri P. Faldessai, learned Additional Public Prosecutor submitted that in view of the addition of the offence under

2 CRMAB 11 of 2020 Section 384 IPC, the custodial interrogation of the applicant was required.

Without going into the merits of the case and looking to the tenor of case set out by the applicant, the interest of investigation can be met by putting the applicant to terms. 4.

In view thereof, the application is allowed on the following terms:

1. In the event of arrest, the applicant shall be enlarged on bail on executing bail bonds in the amount of ₹15,000/- (Rupees Fifteen Thousand only) and on furnishing a local surety in co-extensive amount to the satisfaction of the I.O.

2. He shall report at the Police Station for a week w.e.f. 11/01/2020 between 10.00am to 12.00noon and cooperate with the course of investigation.

3. He shall not intimidate the witnesses or otherwise hamper or impede the course of investigation.

In these terms the application stands disposed off.
