Mr. S. Desai, learned counsel for the Petitioner points out that this petition had raised a challenge to an interim order made by Respondent No.2. He points out that the matter has now been finally disposed of and therefore, in that sense this petition has been rendered infructuous.

2. Accordingly, he seeks leave to withdraw this petition but with liberty to challenge the final order made by Respondent No.2, if so advised.

3. Accordingly, leave is granted to withdraw this petition with liberty as prayed for.

4. Should the Petitioner decide to challenge the final order made by Respondent no.2, it is clarified that all contentions of all parties as raised in this present petition are kept open. The interim order, if any, does not survive the disposal of the petition and is accordingly vacated.

5. The petition is disposed of in the aforesaid terms. There shall be no order as to costs.
