This application by the applicant seeks custody of his minor children and visitation rights.

2. Mr. I. Agha, learned Counsel appearing for the respondent states that the applicant has filed counter claim in the trial Court for custody of his minor children and also for visitation rights. The order of the first appellate authority which is impugned in appeal also records the fact that the counter claim before the trial Court seeking custody and/or in the alternative visitation rights to the minor children has not yet been disposed of by the trial Court.

3. In view of the above, it will be open to the applicant to move the trial Court to press for the hearing of the counter claim or seek

MCA/36/2015 custody of children under other provisions of law as advised.
