By this application, the applicant is seeking anticipatory bail in connection with crime No.216/2021 registered at Mapusa Police Station for the offences under Sections 406, 420 and 506(ii) of the Indian Penal Code(IPC).

This Court by order dated 27.1.2022 had granted ad-interim relief in favour of the applicant on the conditions that he cooperates with the investigation and remains present at the police
station from 30.1.2022 every day between 10.00 am to 12.00 noon.

Thereafter this application was adjourned, taking note of the fact that the applicant was indeed cooperating with the investigation and that he would be producing certain documents demanded by the Investigating Officer.

Today when the application is called out for hearing, this Court is informed that the applicant has remained present before the Investigating Officer on each day from 30.1.2022, till date and that he has produced documents as demanded by the Investigating Officer.

Considering the nature of the allegations made on behalf of the applicant and the admitted position that in terms of the direction given by this Court, the applicant has regularly attended the police station and presented himself before the Investigating Officer, thereby indicating that he has co-operated with the investigation, this Court is inclined to allow the present application.

In view of the above, the application is allowed in the following terms:-
ORDER
i. It is directed that in the event the applicant is arrested in connection with Crime No.216/2021 registered at Mapusa Police Station for the offences under Sections 406, 420 and 506(ii) of the IPC, he shall be released on bail on furnishing a personal bond of Rs.25,000/- (Rupees twenty five thousand only) and surety in the like amount to the satisfaction of the Investigating Officer. ii.
The applicant shall continue to co-operate with the investigation and remain present before the Investigating Officer as and when required.
iii.
The applicant shall not himself or through any other person indulge in any activity that would tamper with the evidence or influence the witnesses.
