Mr Diniz, learned Senior Advocate who appears along with Mr Govekar files a memo confirming that service has been effected upon the respondent. The memo is to be taken on record.

2. Mr Diniz further states that an amount of Rs.15,00,000/- (Rupees Fifteen Lakhs only) has been deposited in this Court in terms of the statement made and recorded in this Court's order dated 04.11.2023.

3. This is an application seeking condonation of 142 days in instituting the appeal. Considering the averments made in the civil application including the averments relating to health issues and the 15th December, 2023

MCA 573 of 2019 applicants being embroiled in some criminal proceedings, the delay of 142 days is condoned. A sufficient cause is shown for condoning this delay.

4. Accordingly, the delay is condoned and this civil application is disposed of.

5. The appeal is to be registered and placed for admission on 11.01.2024.

6. It is made clear that neither the deposit of Rs.15,00,000/- (Rupees Fifteen Lakhs only) nor the pendency of this appeal should be a ground to seek any adjournments in the pending execution proceedings because till now neither is any stay applied for nor is the same granted. Therefore, the Executing Court must proceed with the execution. A copy of this order to be send by the Registrar (Judicial) to the Executing Court.
