ORAL ORDER:

By consent of the parties, the petition is disposed of in the following terms:

i.

The petitioner shall carry out repairs only of the walls and the roof of the suit house no. 61/2, which is in possession of the petitioner, as identified in the Commissioner's report marked 'X' for identification.

ii.

Except this, the petitioner shall not carry out any construction or repairs to any other portion of the house. iii.

This shall not create any equities in favour of the petitioner. iv.

Rival contentions of the parties in the Civil Suit are left open.

v.

The petition is disposed of in the aforesaid terms with no order as to costs.
