The learned counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to challenge the resolution dated 4/1/2016 by which, the construction undertaken by the respondent has been regularized by the Town and Country planning department and other related permissions. In such circumstances, the petition is disposed of as withdrawn with liberty as prayed for. It is made clear that this Court has not expressed any opinion on the rival contentions on merits. C. V.
