MCA No. 43 of 2025 seek condonation of delay of 9 days in filing the Appeal.

On hearing the learned Counsel for the Applicant and on perusal of the Application, since it is pleaded that the delay was not deliberate, but was due to inadvertence, I deem it appropriate to condone the delay.

The Second Appeal is directed to be registered and listed for admission on 14.11.2025.

2. The learned Counsel for the Applicant state that there is one more Miscellaneous Civil Application, which is yet to receive registration, which seek deletion of the name of Respondent No. 2 as she is informed to have passed away on 10.09.2024 without leaving any legal heir.

MCA 43 of 2025 Subject to the Registry granting registration of the Miscellaneous Civil Application and on perusal of the Death Certificate annexed to the Application, the Application is made absolute. Necessary amendment to be carried out in the title cause of the Second Appeal forthwith.
