Heard Mr. Naik, learned Counsel appearing on behalf of the applicant and Mr. Rivankar, learned Public Prosecutor for the respondents.
2. By this application, the applicant has prayed for permission to go to China for 60 days in connection of his Optical Trading Business and for that matter to direct the respondent no.1 to hand over his passport to him.
3. The Investigating Officer has filed reply stating that in case the application is granted appropriate conditions be imposed on the
CRMA/22/2015 applicant.
4. By order dated 30/04/2014 passed in Criminal Application (Bail) No.51 of 2014, the applicant is granted bail in Crime no.19 of 2012 registered with C.I.D. Economic Offence Cell, Panaji - Goa upon execution of P.R. Bond with surety and under certain conditions. One of the conditions was that the applicant should deposit his passport with the Investigating Officer. It is reported that in compliance of the said order, the applicant has deposited his passport with the Investigating Officer. It is seen that though the case is under investigation, most of the investigation has been completed and charge sheet is going to be filed shortly. In view of the above and in the interest of justice, since the applicant wants to go abroad for his business purpose and that also only for 60 days, I do not see any reason for not considering the request favourably.
5. In the result, the application is allowed. The applicant is permitted to go to China for 60 days in connection with his Optical Trading Business as from 02/02/2015. The Investigating Officer of Crime No. 19 of 2012 shall return the passport of the applicant to him forthwith. The applicant shall return back on or before 04/04/2015 and shall report to the Investigating Officer and deposit his passport with the Investigating Officer. The applicant shall inform the Investigating Officer his address at China.
