Since the very same Order impugned in this Petition is subject matter of challenge in Writ Petition No. 672 of 2012, learned Counsel for the Petitioner seeks leave to withdraw the Writ Petition.

2. Writ Petition No. 103 of 2023 is allowed to be withdrawn.

3. It is made clear that this Court has not entered the merits of the controversy as the contentions raised by the Petitioner is already a subject matter for consideration in Writ Petition No. 672 of 2012. All contentions are left open.
