2. The challenge in this appeal is to the order of rejection of application for temporary injunction.

3. Mr. Naik, the learned Counsel for the appellant-original plaintiff, on instructions, states that the appellant is not pressing the application for temporary injunction.

4. In such circumstances, nothing survives in the Appeal from Order which is accordingly disposed off as infructuous with no order as to costs.
