IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 61 OF 2015 SHRI. DATTARAM NAIK.

... Petitioner

Versus

PONDA MUNICIPAL COUNCIL THROUGH ITS CHIEF OFFICER AND ANR., ... Respondents Shri Hanumant D. Naik, Advocate for the petitioner. Shri G. Agni, Advocate for respondent No.1.

Coram:- F. M. REIS & K. L. WADANE, JJ.

Date:- 28th January, 2015 P.C.:

Heard Shri H. D. Naik, learned Counsel appearing for the petitioner and Shri G. Agni, learned Counsel appearing for respondent No.1.

2. The above petition, inter alia, seeks direction to the South Goa Planning and Development Authority to examine the application for regularisation filed by the petitioner in view of the order passed by this Court dated 6th August, 2013. Shri Naik, learned Counsel appearing for the petitioner points out that though such an application was filed on 30th October, 2013, no action has yet been taken by the concerned Authority.

3. Upon hearing the learned Counsel and on perusal of the said

WP/61/2015 order passed by this Court dated 06/08/2013 wherein it is clearly mentioned that the intention of the petitioner to file an application for regularisation would not delay the process of demolition, the question of interference in such demolition by this Court would not at all be justifiable. Needless to say, the Authority-respondent No.2 shall examine the application, in accordance with law expeditiously, if the same is not yet decided.

4. The petition stands accordingly disposed of. K. L. WADANE, J.

F. M. REIS, J.
