Heard Shri G. Teles, learned Advocate appearing for the petitioner and Shri P. Faldessai, learned Addl. Public Prosecutor appearing for the respondents.

2. The grievance in the petition is that the proceedings before the NDPS Court are delayed as the prosecution is not in a position to make the witnesses available as and when the matter is posted for hearing.

3. Shri P. Faldessai, learned Addl. Public Prosecutor submits that though there has been some delay in conducting the matter, nevertheless, according to him, there are three more witnesses to be examined including the Investigating Officer. The learned Addl. Public Prosecutor further points out that there are old

WPCR/18/2017 matters pending before the NDPS Court.

4. In the peculiar facts and circumstances of the case, the hearing of the Special Criminal Case No.23/2015 is expedited and the learned Judge shall preferably dispose off the said Special criminal case by 31.12.2017. Needless to state that the prosecution shall ensure the presence of the witnesses as and when the matter is posted for hearing.
