2. Ms Monteiro files an affidavit of service.

3. This Civil Application seeks the condonation of delay of 22 days in instituting the Second Appeal. This application is opposed by Mr Agha by filing a reply and contending that this delay is not bonafide.

4. Considering the material on record including in particular the application and the reply, a case is made out for condonation of delay. 15th September, 2023

5. Besides, this is a case where the Second Appeal No.5 of 2023 filed by Respondent No.1 is already admitted. This appeal is in the nature of cross-appeal.

6. For the above reasons, the delay is condoned.

7. The Misc. Civil Application No.81 of 2023 is disposed of by condoning the delay.
