On 18 September 2018, the following order was passed. "The Petitioners- Educational Institution has challenged the order passed by the Authorised Officer promoting the Respondent No.4 as Headmaster by order dated 1 June 2011. The main contention raised in this petition is that such order could not have been passed without consulting the Petitioners. While issuing Rule, no interim relief was granted.

From the record, it appears that the age of the Respondent No.4 in the year 2011 itself was 58 years. Therefore, the Respondent No.4 must have superannuated by now. The petition could have disposed of infructuous today however, since the learned counsel for the Petitioners is not present, stand over to 16 October 2018.

The learned counsel appears for the Petitioners and states that the Petitioners have not contacted him. He also states that the Respondent No.4 might have superannuated by now. In view of this position, it appears that the Petitioners are not interested in prosecuting the petition. The petition is dismissed for non prosecution.
