IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 214 OF 2015 M/S. MOONRISE TOURISM PRIVATE LTD., REP. BY EXECTUIVE DIRECTOR CLAUDIA MARIA DERAIN.

... Petitioner

Versus

THE STATE OF GOA, REPRESENTED BY THE SECRETARY (REVENUE) AND ANR., ... Respondents Mr. F. E. Noronha, Advocate for the petitioner. Ms. Susan Linhares, Addl. Government Advocate for respondent nos. 1 and 2.

Coram:- F. M. REIS & K. L. WADANE, JJ.

Date:- 22nd April, 2015 P.C.

Heard Mr. F. E. Noronha, learned counsel appearing for the petitioner and Ms. S. Linhares, learned Addl. Government Advocate appearing for the respondents.

2. Upon hearing the learned counsel, we find that the short grievance raised by the petitioner is that the application for mutation bearing case No.1113/ARP/98 pending before the Joint Mamlatdar-I, Bardez Goa, has not yet been disposed of though such application is pending for a long period of time. On the earlier occasion, the petitioner has approached this Court and it was pointed out by the Government Advocate that such application could not be disposed of in view of the missing of the file which was in the process of

WP/214/2015 reconstruction. It is brought to our notice that such file has not yet been traced nor reconstruction has been completed. The learned Addl. Government Advocate appearing for respondent no.2 points out that respondent no.2 shall dispose of such application for mutation bearing case No.1113/ARP/98 as expeditiously as possible and in any event within six months from today. Accepting the said statement of the learned Addl. Government Advocate upon instructions of respondent no.2 who is present in Court as an undertaking to this Court, we dispose of the petition. Parties are directed to appear before the respondent no.2 on 04.05.2015 at 10.30 a.m.
