IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 113 OF 2015 SHRI. M. ASHRAF NAGARWALA.

... Petitioner

Versus

THE CHIEF OFFICER, MARGAO MUNICIPAL COUNCIL AND 3 ORS., ... Respondents Mr. Ashwin D. Bhobe, Advocate for the Petitioner. Mr. Nikhil Pai, Addl. Government Advocate for the Respondent nos. 1 and 4.

Coram:- F. M. REIS & K. L. WADANE, JJ.

Date:- 18th February, 2015 P.C.

Heard Shri A. D. Bhobe, learned Counsel appearing for the Petitioner and Shri PAi, learned Addl. Government Advocate appearing for the Respondent nos. 1 and 4.

2. The short grievance of the Petitioner is that the Respondent nos. 2 and 3 who had preferred an Appeal before the Respondent no. 4 have obtained an ad-interim relief which has not yet been disposed of by the Respondent no. 4 though according to the Petitioners, both the parties have already filed their written submissions in support of their rival contentions in the main Appeal.

3. Learned Addl. Government Advocate appearing for the Respondent no. 4 states that the Respondent no. 4 shall dispose off

WP/113/2015 the Appeal within eight weeks from today.

4. Shri A. D. Bhobe, learned Counsel appearing for the Petitioner, opposes such request as, according to him, there were already directions issued by this Court by Order dated 30.09.2013 and 18.11.2014 in Writ Petition no. 612 of 2014.

5. Upon hearing the learned Counsel and on perusal of the Order passed by this Court dated 30.09.2014 in Writ Petition no. 612 of 2014 and the subsequent extension granted by this Court by Order dated 18.11.2013, we find it appropriate to direct the Respondent no. 4 to dispose of the said Appeal positively within six weeks from today.

6. All the contentions of both the parties are left open. K. L. WADANE, J.

F. M. REIS, J.
