The petitioners have filed precipe seeking to withdraw the petition, with liberty to raise the challenge under Section 105 of the Civil Procedure Code, at the appropriate stage.

2. The petition is disposed of as withdrawn, with no order as to costs.

Needless to mention that if, a ground under Section 105 of the Civil Procedure Code is raised in an appeal challenging the decree passed in the suit, the same shall be decided on its own merits. It is made clear that this Court has not expressed any opinion on the merits of any such contention.
