Shri Byron Rodrigues, learned Advocate for the respondent no.1 submits that he has moved an application for withdrawal of Civil Suit No.9/2014/Fast Track/II unconditionally and discharge of the injunction order before the Trial Court.

2. On the basis of the statement of the learned Advocate for the respondent no.1, the Civil Suit No.9/2014/Fast Track/II does not survive and the application for injunction stands discharged. The impugned order in the Appeal From Order stands discharged. As a consequence thereof the appeal also does not survive and is disposed off accordingly.
