The suit for specific performance was decreed by the Trial Court and the Appellate Court while allowing the appeal has dismissed the suit. Such a decree is not amenable to be stayed.

2. Shri Pangam, the learned Counsel for the applicant submits that he may be granted liberty to file an application for injunction, restraining the respondent from creating third party interest.

3. In such circumstances, the Civil Application is disposed of, with liberty as prayed.
