Heard Mr V. Bhandanker, learned counsel for the Petitioner, Mr S. Samant, learned Additional Government Advocate for Respondent Nos. 1 and 3 and Mr S. D. Padiyar, learned counsel for Respondent No.2 ( Mapusa Municipal Council).

2. For the order that we propose to make, no notice is necessary to Respondent Nos. 4 to 8. Mr Padiyar who was present in the Court and who normally appears for the Mapusa Municipal Council was requested to accept the notice in this matter because the only direction that we propose to make is that the Petitioner's complaint dated 31st January, 2024

WP 115 of 2024 11.01.2024 (Annexure A-5) could be disposed of by the Chief Officer in accordance with law and on its own merits as expeditiously as possible within four weeks from serving notices on Respondent Nos. 4 to 8 and the Petitioner. The Chief Officer must dispose of this complaint by giving an opportunity of hearing to the Petitioner and Respondent Nos. 4 to 8. If the Chief Officer thinks that there are any other parties that may be adversely affected, the Chief Officer must grant an opportunity of hearing to such parties as well. The decision on the Petitioner's complaint must be communicated inter alia to the Petitioner within this period of four weeks.

3. We have not examined the rival contentions and therefore, all contentions of all parties are left open to be decided by the Chief Officer in the first instance.

4. The petition is disposed of in the above directions. There shall be no order for costs.
