Mr. Andre Pereira, states that he is the "Proprietor" in respect of the property which is the subject matter in this Petition. He complains that the Respondent including, in particular, Respondents No. 2 and 3 have encroached upon the suit property.

According to us, the dispute raised by the Petitioner is a purely civil dispute which can be adjudicated before the Civil Court. There are disputed questions of fact involved in this matter and it will not be proper for us to go into such disputed questions of fact in exercise of our extraordinary jurisdiction under Article 226 and 227 of the Constitution of India.

Accordingly, on the aforesaid short ground we dismiss this Petition. However, we grant liberty to the Petitioner to take such steps as he may be advised in order to seek redressal with respect to his grievance. 5.
