Oral Order:

Leave is granted to amend the Revision Application so as

to challenge the Order dated 23.01.2018 in Case No.376/138/ NIA 2011/B. The amendment to be carried out forthwith. 2.

Mr. Ramaiya, states that a settlement has been arrived at between the petitioner and the respondents' Society. In terms of the settlement, the petitioner has deposited the entire compensation amount which includes the cheque amount in this Court. He submits that the Society may be permitted to withdraw this amount and the offence may be compounded.

Mr. Balwantrao Jaiwantrao Dessai, is present on behalf of the respondent Credit Society. He produces on record the Resolution of the Society authorizing him to appear in this matter and to accept the resolution on behalf of the Society. He also files a copy of his Aadhar Card.

Mr. Balwantrao Jaiwantrao Dessai, states that the Society has no objection for the offence being compounded now that liberty is being granted to withdraw the amount deposited by the petitioner in this Court.

Accordingly, the Society is granted to withdraw the amount deposited by the petitioner in this Court together with the interest that may have accrued on such amount.

The offence for which the petitioner stands convicted is hereby compounded. This means that the impugned Order and Judgments convicting the petitioner are set aside. 7.

The Registry to permit the respondent Credit Society to withdraw the amount.

8.

This Revision Petition is disposed off in the aforesaid terms.

9.

The Miscellaneous Applications do not survive and even they are disposed of.

10.

All concerned to act on the authenticated copy of this Order.
