On 17/02/2017, a notice was issued for the limited extent of the order directing handing over of the RC book. The petitioner had categorically denied that she is in possession of the RC book of the concerned vehicle. This aspect cannot be gone into in this petition being a pure disputed question of fact.
2. The learned Counsel for the respondent in all fairness states that if the vehicle is handed over to him the respondent would be in a position to obtain a duplicate RC book, from the competent authority.
3. Having heard the learned Counsel for the parties, I find that the part of the order directing the petitioner to hand over the RC book cannot be sustained. Accordingly, the same is set aside.
WP/159/2017 The rest of the order directing delivery of the vehicle is hereby confirmed.
