2. During the course of arguments, it is transpired that the learned CJM is seized of the proceedings and yet to pass an order under Section 156(3) Cr.P.C. These proceedings on the face of the record are rather premature at the instance of the petitioner. Hence, dismissed.

3. The learned Chief Judicial Magistrate, however, to dispose off the application at large, within three months, from the date of the order.
