IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 153 OF 2016 SHRI. SEBASTIAO PEREIRA AND 3 ORS., ... Petitioners

Versus

SHRI SADASHIV SARWOTTAM SAWARDEKAR AND 17 ORS., ... Respondents Shri Ashwin D. Bhobe, Advocate for the petitioners. Shri Carlos Alvares Ferreira, Advocate for the respondent nos. 9 to 13.

Coram:- F. M. REIS, J.

Date:- 1st December, 2016 P.C.

Heard Shri A. D. Bhobe, learned Advocate for the petitioners and Shri C. A. Ferreira, learned Advocate for the respondent nos.9 to 13.

2. The challenge in the above petition is to the refusal of leave to amend the petition and the documents in the course of proceedings under Section 7 of the Agricultural Tenancy Act, 1964.

3. The question of interference in the impugned order, at this stage would not at all be justified, as there is no jurisdictional error committed by the authorities below.

4. Shri Bhobe, learned Advocate, however points out that the petitioners have also sought leave to produce two writings, which according to him, are rent receipts. Shri C. A. Ferreira, learned Advocate, however disputes that they are rent receipts and that they are referable to the subject property or signed by the respondents or

WP/153/2016 their ancestors.

5. Keeping all such objections open, I find that the petitioners may be granted leave to rely on the said two documents, subject to the proof of the authenticity and contents thereof, in accordance with law.

6. With the above observations, petition stands disposed off accordingly.
