Heard Shri Anthony D'Silva, learned Counsel appearing for the Petitioner and Shri P. Faldessai, learned Additional Government Advocate appearing for the Respondents no. 1, 2 and 3.

2. We are not inclined to examine the merits of the rival contentions as the grievance of the Petitioner essentially with regard to the compound wall constructed without due permissions from the statutory authorities which is causing prejudice to the Petitioner who is the adjoining owner. The Petitioner, if so advised, would have to get his alleged prejudices adjudicated in the proper forum.

3. Be that as it may, it is pointed out that the matter is pending before the Dy. Director of Panchayats from the year 2012. Such proceedings would have to be disposed of expeditiously in accordance with law. The learned Additional Government Advocate assures that the proceedings shall be disposed of expeditiously.

4. Needless to say, we have not examined the merits of the rival contentions and the issues are left open.
