2. This is an application for condonation of delay of 87 days in filing the First Appeal challenging the judgment of the learned District Judge whereby the counter claim filed by the applicants came to be dismissed. The delay is explained by filing an affidavit inter-alia stating that on account of administrative reason the appeal could not be filed within time. The respondents though served have failed to remain present. The statement made in the application along with the affidavit has been uncontroverted. Hence, the application is allowed. The delay is condoned.
