Heard Shri J. Abreu Lobo, learned Advocate for the petitioners and Shri Gaurish N. Agni, learned Advocate for the respondent Nos.59, 60 and 61(a to d) for sometime.
2. In the course of the arguments it was suggested to both the parties that the issue can be resolved by the parties having a joint inspection at loco in the presence of their respective surveyors and the official Surveyor from the Director of Settlement and Land Records who shall identify the property on the basis of the boundaries set out in the Sale Deed Dated 12/10/2007 and identify the same at loco. The Official Surveyor then shall superimpose the plan identifying the suit property on the official
WP/1041/2017 survey plan which will facilitate the process of partition thereafter and submit it to the office of the Deputy Collector who shall finally decide the partition application.
3. The parties shall appear before the Deputy Collector on 23/07/2018 at 15.00hrs. The Deputy Collector then shall finally decide the partition application once and for all.
4. The Deputy Collector shall ensure that the entire partition proceedings are culminated within a period of three months from 23/07/2018.
5. No opinion has been expressed on the merits of the case.
6. With these directions and on these terms the petition stands disposed off.
