The learned Counsel for the petitioner states that he proposes to amend the plaint including the prayer clause for incorporating appropriate prayers and then file a fresh application for production of additional documents. He therefore, on instructions, seeks permission to withdraw this petition.

2. Without expressing any opinion as to the merits of any such application for amendment of the plaint and/or the application for production of additional documents, if any filed, the petition is disposed of as withdrawn. Needless to mention that if, the petitioner files any such application, the trial Court shall decide the same on its own merits and in accordance with law. All rival contentions of the parties are left open.
