Shri Ryan Menezes, learned Advocate invited my attention of the impugned order dated 23.12.2019 pursuant to which the Inspector General of Prisons had rejected the application on the premise that it was infructuous as he had exhausted the period of 28 days as per his eligibility. It was contended by Shri Menezes, learned Advocate that the applications of three other convicts had been allowed within the same year i.e. 2019 as stated in paragraphs 9 of his application and that the applicant had been denied furlough even though his case was similar to the case of the other applicants.

2. Be that as it may, the Inspector General of Prisons to consider the application of the applicant based on the same police report and dispose off the same within two weeks from today.

3. The Inspector General of Prisons to consider the judgments of this Court in Criminal Writ Petition no.23/2011 and Criminal Writ Petition no.6/2020 while deciding the furlough application of the applicant.
