IN THE HIGH COURT OF BOMBAY AT GOA

CRIMINAL WRIT PETITION NO. 27 OF 2018 RAVINDRA KUMAR JHA, PRESENTLY AT CENTRAL JAIL COLVALE., ... Petitioner

Versus

STATE OF GOA, THR. INSPECTOR GENERAL OF PRISON, PANAJI AND ANR., ... Respondents Shri. T. George John, Advocate for the petitioner. Shri Mahesh Amonkar, Additional Public Prosecutor for the respondents.

Coram:- C. V. BHADANG & NUTAN D. SARDESSAI, JJ.

Date:- 8th February 2018 P.C.:

By this petition, the petitioner is seeking reduction of the security amount. By an order dated 23/01/2018, the petitioner has been directed to be released on furlough, inter alia, on a condition of furnishing a bond in the sum of Rs.1,00,000.

2. It is contended that the petitioner is unable to furnish the bond and the amount of bond may be suitably reduced.

3. We have heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor for the respondent-State. This Court in several orders has found that the

WPCR/27/2018 amount of bond should be commensurate with the facts and circumstances of the case and it should not be exorbitant so as to deny the benefit of parole or furlough.

4. In view of the submissions and the circumstances, we find that the amount of bond can be reduced to Rs.25,000. The impugned order is modified to that extent. All other conditions, as imposed by the impugned order, subsist.

5. With the aforesaid modification, the petition is disposed of.
