The Court disposed of Appeal from Order on 5.3.2019. Then it required the Trial Court to dispose of the suit in one year. As the matter is pending before the Commercial Court, the time cap is justified. In fact, as it is reported, the Trial Court has been proceeding with the matter with utmost dispatch and expedition.

Nevertheless, now the counsel for both the parties inform the Court that as the matter has been proceeded with before the Trial Court almost on a day-to-day basis, it has been causing inconvenience to the witnesses, as well as the parties concerned. According to them, the matter does not involve any urgency, to be taken up on a day-to-day basis. Therefore, they jointly want this Court to lift the time cap of one year, which is soon to end.

Under these circumstances, besides appreciating the Commercial

- 2 - MCA83-20 Court's commitment to complying with this Court's direction, I hold that, as agreed to by the parties, the time cap imposed by this Court earlier stands relaxed.

As a result, Trial Court may proceed with the matter as per its convenience.

Application stands disposed of.
