Shri Phadte, the learned Counsel for the petitioner submits that there are subsequent events, namely the second respondent having attained majority and the petitioner having lost his job, which have a bearing on the order, granting maintenance against the petitioner. The learned Counsel submits that the petitioner intends to file an application for modification of the order before the learned Magistrate under Section 127 of Cr.P.C. He, therefore, on instructions, seeks leave to withdraw the petition, with liberty to apply for modification.

2. In such circumstances, the petition is disposed of as withdrawn.

3. Needless to mention that if the petitioner files an application for modification, the learned Magistrate shall decide the same on its own merits and in accordance with law.
