IN THE HIGH COURT OF BOMBAY AT GOA
CIVIL APPLICATION NO. 257 OF 2015 IN FIRST APPEAL NO. 112 OF 2015 DY. COLLECTOR (REV) AND LAND AQUISITION OFFICER AND ANR., ... Applicants
Versus
CHANDRU L. NAIK AND 2 ORS., ... Respondents Ms. P. Kamat, Addl. Government Advocate for the Applicants. Adv. Pranay A Kamat for Respondent no. 1.
Mr. S. Dhargalkar, AGA in F.A. No.192/2003.
Coram:- C. V. BHADANG, J.
Date:- 8th February 2019 P.C.:
This is an application for stay.
2. The learned Additional Government Advocate points out that the entire amount of the impugned award has been deposited in a connected First Appeal no.192/2003, which aspect is not disputed by the learned counsel for the respondent. It appears that the amount of compensation has been apportioned between the landlord and the tenant of the acquired land in respect of which these two appeals are filed. In any event having regard to the fact that the amount is deposited in F.A. No.192/2003, a separate deposit of the amount will not be necessary in this
CA/257/2015 application. Accordingly the order dated 6/4/2018 is modified to that extent.
3. There shall be interim stay of the impugned award during the pendency of the appeal.
4. By consent of parties, both these appeals, i.e F.A. No.112/2015 and F.A. No.192/2003 to stand over for final hearing on 8/3/2019.
C. V. BHADANG, J.
