Advocate for the applicant submits that the cause title of the order in the A.U.S.F.C No. 1/ 2019 carries the same cause title, so, there is no change in the cause title. Considering it, the said objection does not survives. So, the application be registered, if rest of the office objections are cleared.
The applicant has filed this application to issue notices to respondent nos. 1 and 2(a) as notices returned unserved. Vide bailiff report dated 03.10.2019, of the Senior Judge Civil Division, Honavar, Uttar Kanada, Karnataka. The notice of respondent no. 2(a) returned unserved vide bailiff report dated 15.10.2019 of City Civil Court, Bangalore, Karnataka with the reason that the respondent no. 2(a) has left the address.
According to the applicant, it is the last known address. I am satisfied that the notices to respondent no.1 and 2(a) will not be served by ordinary mode. So, the application is allowed in terms of prayer clause a. (i) and (ii) of the application. The applicant shall collect the notice, get it published and shall file the affidavit of service alongwith the newspaper.
