The application seek withdrawal of the amount deposited in the Court subject to which interim relief was granted. As the appeal is filed, raising a challenge to the money decree and as a pre-requisite, an amount of Rs.5 lakh is deposited. Since the appeal is yet to be heard, I do not think that the respondent is justified in seeking its withdrawal. The application is therefore dismissed.

Since the learned counsel for the applicant request that the appeal be taken up for hearing, subject to the paper book being either prepared or private paper book being furnished by the parties, the 19th September, 2025
