The Petitioner has engaged in the activities of extraction and sale of iron ore within the State of Goa. The Petitioner has sought a declaration that the Goa Rural Improvement and Welfare Cess Act, 2000 and Rules made thereunder and the Notifications be declared as ultra vires and consequential direction.

In a group of matters seeking similar declaration, the Writ Petition No.670 of 2010 was treated as lead petition and the decision was rendered on 26 September 2018. In view of the decision so rendered, the grounds made out in the petition stand answered. The
