Heard this petition for considerable length and it was adjourned from time to time to explore the possibility of settlement. We had done so, since the Petitioner and the Respondent no.5 are neighbours and it would have been in best the interest of both to put an end to the dispute amicably however it has not taken place. 2.

Having heard the learned Counsel for the parties, in Writ

vinita 2 WP298-18 dt -11.9.18 jurisdiction to adjudicate the controversy as various disputed questions of fact are involved. What the Petitioner essentially seek is an order of injunction against the private Respondent. We are informed that parties have already approached the Civil Court and Civil Suit is pending. Keeping all the contentions of the parties open to be agitated in the civil suit, we dispose of this Writ Petition. Prithviraj K. Chavan, J. N.M. Jamdar, J.
