Shri D. Lawande, Advocate General with Shri P. Dangui, Additional Government Advocate for Respondents No.3 & 4. Coram:- F. M. REIS & NUTAN D. SARDESSAI, JJ.

Date:- 4th May, 2017 ORAL ORDER :

Heard Ms. A. Kamat, the learned Counsel appearing for the petitioner and Shri D. Lawande, the learned Advocate General appearing for the respondents.

2. The learned Advocate General points out that as the formalities of handing over charge by the petitioner has not been completed there was a delay in processing the retirement benefits of the petitioner. The learned Advocate General further submits that the petitioner may be called upon to remain present in the office of the respondent no.1 on 11/05/2017 at 11.00 a.m. and complete the formalities and immediately thereafter within

WP/403/2017 one week the requisite formalities to release his retirement benefits would be carried out.

3. The learned Counsel appearing for the petitioner however disputes that on account of any default on the part of the petitioner such charge was not delivered. But however, without going into the rival contentions with that regard the petitioner is called upon to remain present on 11/05/2017 on 11.00 a.m. in the office of the respondent no.1 to complete the formalities of handing over charge and the statement of the learned Advocate General that the process of the petitioner getting retirement benefits shall be completed within one week thereafter stands accepted. With the said directions and accepting the said statement, petition stands disposed off.
