Heard Mr. J. E. Coelho Pereira, learned Senior Advocate along with Ms. Tanvi Parab, learned counsel for the petitioner and Mr. G. Malik, learned counsel for the respondent.

2. This is an application for stay of the proceedings/Civil Suit before the trial court on the ground that though revision has been admitted by this Court challenging the impugned order of disposal of the application under Order 7 Rule 11 of CPC.

3. Mr. Pereira, learned Senior Counsel pointed out that applicant has already filed written statement along with application for condonation of delay which is now pending for argument.

Considering the fact that the revision has already been admitted and kept for final hearing, the trial Court is directed to go head with the miscellaneous proceedings except recording of evidence of the parties on merits.

4. Civil Revision Application shall be placed for final hearing on 11.1.2024.

5. Civil Application stands disposed of in above terms. BHARAT P. DESHPANDE, J.
