Ms. M. Furtado, the learned Counsel for the appellant mentions the appeal to be taken up for consideration. The matter is already on board for final hearing. Ms. Furtado submits that the execution proceedings are pending before the Civil Judge Senior Division, Mapusa which are being settled between the parties. She submits that consent terms will be tendered in the execution proceedings which are listed before the Civil Judge tomorrow. It is submitted that precondition for executing the consent terms is withdrawal of the present appeal. She accordingly seeks leave to withdraw the appeal. She states that appellant no.1(a) is present in the Court.
