Sushila Harishchandra Shinde v. State Of Goa And 2 ORS.,
Amrut 1 WP173-10dt 06-09-2018 IN THE HIGH COURT OF BOMBAY AT GOA WRIT PETITION NO.173 OF 2010 Smt. Sushila Harishchandra Shinde ...
Petitioner
Versus
State of Goa & Ors.
.... Respondents Ms. N. Kholkar, Additional Government Advocate for the Respondents.
Coram : N.M. Jamdar & Prithviraj K. Chavan, JJ.
Date : 6 September 2018.
P.C.:
The Petitioner has filed this petition making a grievance regarding her wages and benefits as available. According to the Petitioner, the Petitioner is a daily wage labourer with the Forest Department since August 1995. The Petitioner has referred to a Scheme of the State Government as the Daily Wages ( grant of temporary status ) Scheme of Government of Goa, 1997. It appears that the Petitioner has made certain representations to the Conservator of Forest based on the Scheme and sought higher wages and other
Amrut 2 WP173-10dt 06-09-2018 benefits. The Petitioner has annexed series of representations made by the Petitioner in the petition. It is averred that the Petitioner was not granted benefits because the Petitioner has not completed five years. This writ petition was filed in the year 2010. If the Petitioner is continued to be daily wage labourer, the question whether the Petitioner would be entitled to the benefits of the Scheme and other reliefs sought for would arise.
2.
We, therefore, deem it appropriate that the Respondent No.2-Conservator of Forest takes a decision upon the prayers made by the Petitioner treating the petition as a representation. The decision to be taken as per law. The Respondent No.2 will give notice to the Petitioner to remain present and supply additional documents if the Petitioner so desires. The Respondent No.2 will give notice to the Petitioner as above within a period of six weeks and after giving some time to the Petitioner to submit the documents if sought for, take a decision thereafter within a period of eight weeks. 3.
The writ petition is accordingly disposed of in the above terms.
