Heard Shri Ramani, learned Counsel for the appellant and Shri Lobo, learned Counsel for the respondent no. 1.

2. It is submitted by the learned Counsel for the appellant that for the present, the appellant has no intention of alienating or creating any third party interest in the disputed property. It is submitted that the appellant has purchased the property for business purpose and in a given case occasion may arise for mortgaging the property for raising finance. However, at this stage, the appellant has no such intention and the appeal may be disposed of with a direction to decide the suit as expeditiously as possible.

3. Both the learned Counsel submit that issues have been framed in the suit and the suit is ripe for hearing. It is also submitted that the parties shall co-operate for early disposal of the suit and that the appeal be disposed of accordingly.

4. In view of the above, the appeal stands disposed of with no order as to costs. The learned Trial Court shall dispose of the suit as expeditiously as possible, preferably within a period of one year from the date of receipt of this order. The parties shall co-operate for early disposal of the appeal.
