2. On perusing the averments in the Misc. Civil Application, sufficient cause is shown for condoning the delay, if any, and allowing the application in terms of prayer clauses (a) and (b). The delay is condoned. Abatement, if any, is set aside.

3. This application is allowed in terms of prayer clauses (a) and (b) which read as follows:

(a) The legal representative of the deceased Applicant No.2 i.e. the Applicant No.1 be brought on record as Applicant No.2(a) and the other legal representative as referred to in para 2 i.e. Ms. Suchitra 20th October, 2023

MCA 248 of 2021 Rajan Lotlikar be brought on record as Appellant No.2(b) and the Applicant No.1 be permitted to amend the cause title of the memo of appeal by adding the words "since deceased represented by the legal representative i.e. Appellant Nos. 2(a) and Appellant No.2(b); (b) Delay if any in filing the present application for bringing the legal representative be condoned.

4. Mr Bhobe states that he will appear on behalf of the legal representatives of the deceased Appellant No.2.

5. Misc. Civil Application No.248 of 2021 is disposed of. M. S. SONAK, J.
