1. Heard Mr Prasheen Lotlikar with Mr Bhavesh Lotlikar, learned Advocates for the petitioners and Mr Nikhil Vaze, learned Additional Public Prosecutor for the State.

2. Mr Vaze pointed out that the Investigating Officer has filed 'C' Summary proceedings before the Children's Court. Considering the above statement, the grievance raised in the present petition stands worked out.

3. We are not inclined to consider the submissions of Mr. Lotlikar as to whether it should be either 'A' Summary or 'B' Summary. The said 27th September, 2023

WPCR 57 of 2023 aspect has to be considered by the concerned Magistrate.

4. In view of the above development, nothing survives in the present petition and it stands disposed of.

5. The Magistrate is directed to dispose of 'C' Summary proceedings as early as possible.
