This is an application for bail. The applicant is facing prosecution for the offence punishable under Section 302 of Indian Penal Code (I.P.C., for short). The application for bail was earlier rejected by the learned Sessions Judge and the applicant had approached this Court for bail and that application for bail was withdrawn. Subsequently, the trial has proceeded and it is undisputed that it is nearing conclusion as the Investigating Officer only is remained to be examined. In such circumstances, the learned Counsel for the applicant, on instructions, seeks permission to withdraw the Criminal Application (Bail).
