Heard Mr Sardesai for the petitioner. Learned Advocate General appears along with Mr N. Vernekar, learned Additional Government Advocate for respondent nos.1 and 2.

2. For the relief that is now pressed and for the order that we propose to make no notice is necessary for the third respondent.

3. Mr Sardesai, on instructions, presses for relief in terms of prayer clause (c), i.e. disposal of petitioner's representation/complaint/ application dated 21.06.2023 addressed to the Captain of Ports within a time-bound period.

4. The learned Advocate General points out that the proper authority to consider said complaint would be the Director of Tourism. He says that if the petitioner is agreeable, the Director of Tourism will consider and dispose of the petitioner's complaint dated 21.06.2023 within two weeks from the Director receiving a copy of the complaint dated 21.06.2023.

Mr Sardessai states that within a week from today, the petitioner will not only give a copy of the complaint dated 21.06.2023 but also make a further and detailed representation to the Director of Tourism. If this is done within one week from today, the Director, consistent with the learned Advocate General's statement, must dispose of the petitioner's complaint/representation within 15 days from its receipt. Such disposal must be in accordance with law and on its own merits. If rights of any other parties are to be affected, the Director must follow the principles of natural justice and fair play. The Director must communicate his decision to the petitioner within this period of 15 days.

6. Accordingly, this petition is disposed of by issuing the above directions. There shall be no order for costs. All concerned to act on an authenticated copy of this order.
